§1 General Provisions
- The online store (hereinafter referred to as the "Store") conducts retail sales through the Store Owner via the Internet, based on these Terms and Conditions (hereinafter referred to as the "Terms").

- The Terms constitute an integral part of the sales contract concluded with the customer.
- A condition for concluding a sales contract is the Customer's acceptance of the Terms during the ordering process by checking the appropriate box in the order form.
- The prices displayed in the Store are gross prices (including VAT).
- The products available in the Store are free from physical and legal defects.
- The descriptions, images, and prices of the products presented in the Store do not constitute an offer within the meaning of the Civil Code (Article 66).
§2 Orders
- Orders can be placed in the following ways:
- Through the order form available on the Store's website.
- By email to the address provided on the Store's website.
- A condition for fulfilling the order is for the customer to provide data that allows verification of the customer and the recipient of the goods. The Store confirms receipt of the order via email or phone.
- The details provided on the Store's website at the time of placing the order are binding for both parties, especially regarding the price, product characteristics, features, included components, delivery time, and delivery method.
- The information on the Store's website does not constitute an offer within the meaning of the Civil Code. By placing an order, the customer submits an offer to purchase a specified product. The sales contract is concluded at the moment the Seller confirms the acceptance of the Order for execution.
§3 Payments
- The Customer can choose the following payment methods:
a. Payment by credit or debit card – Online payment processing for card payments is provided by Blue Media S.A.

c. Fast online transfer.
d. BLIK payment. - Shipping costs are specified in the shipping price list.
- The condition for the shipment of goods is the payment for the order and the shipping costs.
§4 Shipping
- Ordered goods are shipped via shipping companies (e.g., DHL Parcel) or made available for personal pickup at the Store's headquarters.
- The order processing time begins upon successful payment authorization.
- The delivery time depends on the product's availability. Availability is displayed individually for each item. If the product is in stock, the order is shipped within 2 business days. Orders for custom-made products are fulfilled within the time specified when selecting the product in the Store.
§5 Complaints
- Garbaruk Sp. z o.o., as the Seller, is liable to the Customer who is a Consumer within the meaning of Article 221 of the Civil Code, for non-compliance of the purchased goods with the Sales Agreement, within the scope specified in Articles 556, 556-556³, and subsequent provisions of the Civil Code.
- Complaints related to warranty or statutory liability can be submitted in writing to the company’s address or electronically via email to info@garbaruk.com.
- In case of non-compliance of the goods with the contract, the Customer should return the defective product to the Store at the Store's expense, including a description of the non-compliance.
- The Store will respond to the complaint within 14 days from the date of receipt of the complaint.
- If a justified complaint results in the Customer receiving a new product or a correction of the defect, the shipping costs will be covered by the Store.
- The Seller states that differences in product images resulting from the Customer’s individual screen settings (e.g., color, proportions, etc.) cannot serve as the basis for a complaint.
§6 Right of Withdrawal
- Under the Act on the Protection of Certain Consumer Rights and Liability for Damage Caused by a Dangerous Product of March 2, 2000, a Customer who is a Consumer has the right to withdraw from the contract without giving any reason within 14 days.

A Consumer may withdraw from a distance sales contract within 14 days from the date of receipt of the goods without providing a reason, by submitting a withdrawal statement.
The withdrawal statement can be submitted:
a) In writing to the address: Garbaruk Sp. z o.o., ul. Józefa Piłsudskiego 55, 32-050 Skawina, Poland.
b) Electronically via email to info@garbaruk.com. - Upon successful withdrawal from the contract, the contract is considered null and void. The Customer must return the purchased goods immediately, but no later than within 14 days.
- Within 14 days of withdrawal, the Store Owner will refund the paid amount, including the shipping cost at the lowest available shipping rate for the product, provided the product is undamaged, unused, and in its original packaging. The refund will be processed using the same payment method as used by the Consumer unless the Consumer explicitly agrees to a different refund method that does not involve any additional costs.

The right of withdrawal does not apply in cases specified by the Act mentioned in §6(1), including:
- Services initiated with the Consumer’s consent before the 14-day withdrawal period expires.
- Audio, video recordings, and digital media once the Consumer has removed the original packaging.
- Services whose price depends solely on financial market fluctuations.
- Custom-made products based on the Consumer’s specifications.
- Products that cannot be returned due to their nature or that deteriorate quickly.
- Press deliveries.
- Gambling services.
§7 Privacy Protection
- The Store Owner is the administrator of personal data.
- Personal data provided to the Store Owner is voluntary, but failure to provide certain data will prevent order processing.
- The Customer may separately consent to receiving promotional materials, including commercial newsletters, from the Store.
- The Customer has the right to access, modify, or request deletion of their personal data and to object to its processing.
§8 Intellectual Property
- The use of any materials published on the Store’s website (including product descriptions and images) without written permission from the Store is prohibited.
§9 Entry into Force and Changes to the Terms
- These Terms come into effect upon publication on the Store’s website.
- The Store reserves the right to amend these Terms. Customers will be informed of changes via email at the address provided in their order, 14 days before the changes take effect.
- Additionally, changes to the Terms will be published on the Store’s website 14 days before their effective date.
- Orders placed before the Terms are amended will be fulfilled based on the previous Terms applicable at the time of purchase.
- If a Customer does not accept the new Terms, they must notify the Store Owner within 14 days of receiving the notification.
§10 Additional Provisions
- The Store reserves the right to change product prices. The Customer will be informed of any price changes at the time of order confirmation.
